The Little Explorers Parent Portal (the "Portal"). The Portal is a private, restricted web application owned and operated by Little Explorers Day Care ("we", "us", or "our"). By accessing or using the Portal, you ("you", "User", or "Parent") agree to be bound by these Terms of Use ("Terms"). Please read them carefully before using the Portal. If you do not agree to these Terms, you must not access or use the Portal.

1. Account Creation and Access

  • Restricted Access: The Portal is available exclusively to active clients of Little Explorers Day Care. Access is granted manually at the sole discretion of our administration team.
  • Account Setup: Upon registration, we store minimal personal information (such as your name, email address, and linked child details) necessary to establish and maintain your account.
  • Account Termination: Access is tied directly to your enrollment status. When your child leaves or concludes their early years care with Little Explorers Day Care, your account and access rights will be deactivated and subsequently deleted in accordance with our retention policy.

2. User Credentials and Security

  • Password Management: You are responsible for creating, managing, and maintaining the confidentiality of your account password.
  • Prohibition of Credentials Sharing: You must not share your username, password, or account access with any third party. You agree to notify our admin team immediately if you suspect any unauthorized access to your account.
  • Account Activity: You are responsible for all activities that occur under your login credentials.

3. Confidentiality and Content Ownership

  • Confidential Information: The Portal contains private information intended strictly for registered parents and guardians. This includes, but is not limited to, child updates, announcements, downloadable PDF resources, and private image galleries.
  • Strict Non-Disclosure: You must keep all content obtained through the Portal confidential. You are strictly prohibited from downloading, saving, taking screenshots of, or distributing images, documents, or personal data featuring other children or families outside the Portal.
  • Intellectual Property: All content, trademarks, logos, and materials available on the Portal remain the intellectual property of Little Explorers Day Care or its licensors.

4. Data Protection and Privacy (UK GDPR Compliance)

  • Lawful Basis: We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  • Data Storage: Your personal data is stored securely using cloud infrastructure located in the Firebase europe-west1 (EU West 1) region, ensuring data remains within approved jurisdictions under relevant UK data transfer mechanisms.

5. Acceptable Use

When using the Portal, you agree not to:

  • Attempt to gain unauthorized access to other user accounts, system administrative panels, or underlying code.
  • Use the Portal to transmit any malicious software, viruses, or harmful code.
  • Use any automated means (such as scrapers, bots, or spiders) to access, copy, or download content from the Portal.

6. Media Consent and Image Gallery Usage

  • Parental Consent: All images and videos published within the Portal galleries are displayed on the basis of signed media consent forms provided during your child's initial enrollment.
  • Updating Permissions: You retain the right to modify or withdraw your child's media consent at any time. To update your preferences or request the removal of a specific photo featuring your child, you must submit a written request directly to the day care administration team. We will process and remove the specified content within a reasonable timeframe.
  • Prohibition of External Distribution: Photos and media accessible via the Portal frequently feature other children alongside your own. You are strictly prohibited from downloading, saving, screenshotting, sharing, or publishing any images or videos from the Portal onto public platforms (including personal social media accounts, messaging groups, or public websites).
  • Copyright & Privacy Rights: All images remain the property of Little Explorers Day Care and are protected under UK privacy and copyright laws. Unauthorized sharing or distribution of gallery images constitutes a serious breach of these Terms and may result in immediate suspension of your Portal access, alongside potential legal action for privacy infringement.

7. Limitation of Liability and Availability

  • Service Availability: While we aim to ensure uninterrupted access, the Portal is provided on an "as is" and "as available" basis. We reserve the right to suspend access temporarily for maintenance, updates, or security reasons.
  • Liability: To the maximum extent permitted by UK law, Little Explorers Day Care accepts no liability for indirect losses, service interruptions, or damages arising from your reliance on the Portal, provided that nothing in these Terms excludes liability for death or personal injury caused by negligence or fraud.

8. Governing Law

These Terms, their subject matter, and their formation are governed by and construed in accordance with the laws of England and Wales. You and Little Explorers Day Care both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms.
